Oh John Roberts you crazy SOB. Upholding under the tax power was a pretty big mistake, in my opinion. Here the Court had a chance to limit Congressional power - to draw some distinct, principled distinction on the extent of that power. And while they did limit the commerce power, they gave Congress a complete out. So one of the few things Congress can't do under the commerce power (and we're talking like...one of 2 things the Court has said Congress can't do under that power in the past 80ish years) they can achieve as long as they include a monetary penalty with it. Long story short, the only way to limit Congressional action now is the ever-so-messy substantive due process, something that the Court is extremely reluctant to use.

So I think it's more or less time to hang up the fight against limiting Congressional power. It's a natural progression, I suppose, because over time exceptions accumulate and we've been working on this question for 200 years basically. But it does mean we will have to be more careful in selecting our Congressmen, which (let's face it) isn't going to happen. That's what worries me, but hey maybe people will recognize that.

In any case, we can now return to discussing why Obamacare is horrible policy. Democrats have raised taxes again, and predominantly on the lower middle class. They rammed the law through Congress using dirty tricks. They're feeding literally billions of dollars to health care corporations who, conveniently, were Obama's largest donors. The law is a clumsy solution to problems created by other legislation and which could have been accomplished in a much more effective (both in terms of cost and legislative/judicial hassle) manner. On the whole, the law is probably not going to solve any root problems and was a knee-jerk reaction to absurd statistical comparisons to other countries. It removes a large amount of incentive to create a cost-effective product. It will put a large amount of small businesses in the red, increasing unemployment and perhaps even driving some out of business. And fundamentally, it is another means of government intervention that removes the individual choice of American citizens.

So yeah, the law blows and even its supporters and Obama know it blows - it's nothing near what they wanted and it's nothing near what the country actually needs in terms of health care reform.
